These Terms and Conditions (“Terms”) govern the use of the website and services provided by Braden Saylors (“I,” “me,” or “my”). By accessing this website, booking services or purchasing digital products, you agree to be bound by these Terms.
1. Services
I provide professional photography and related media services. All images, videos and other media are delivered digitally unless otherwise agreed upon in writing. No physical products are shipped.
2. Booking and Payment
Bookings are confirmed only after receipt of payment or deposit, as specified at the time of booking. All prices are listed in [USD] and are subject to change without notice. Full payment must be completed before final digital delivery unless otherwise stated in a written agreement. Payment can be made with Cash, Venmo or Bank transfers after receiving the invoice.
3. Digital Delivery
Final edited files are delivered electronically via online galleries, download links or secure file-sharing platforms. Delivery timelines are estimates and may vary depending on project scope and workload.
Clients are responsible for downloading and backing up their files upon delivery. I am not responsible for loss of files after the delivery access period has expired.
4. Revisions
Editing style reflects my artistic approach and discretion. Minor revisions may be requested within 10 days of delivery. Additional edits or extensive revisions may incur additional fees.
5. Cancellations and Rescheduling
Cancellations or rescheduling requests must be submitted in writing at least 24 hours prior to the scheduled session. Requests made less than 24 hours in advance result in forfeiture of the deposit or full session fee, unless otherwise stated in a written agreement.
Deposits are non-refundable unless otherwise specified. In the event of cancellation by the client, any work already completed may be billed accordingly.
I reserve the right to reschedule due to unforeseen circumstances, including weather conditions, illness, or equipment failure.
6. Copyright and Usage Rights
All photographs and media remain my intellectual property unless otherwise agreed upon in writing.
Clients are granted a commercial license to use the delivered media. Images may not be altered, resold, or redistributed without prior written permission.
I reserve the right to use delivered media for portfolio, marketing, website and promotional purposes unless the client submits a written request to opt out prior to delivery.
7. Client Responsibilities
Clients are responsible for providing accurate information, securing necessary permissions and ensuring access to locations when required. I am not responsible for missed or incomplete coverage due to circumstances beyond my control.
8. Limitation of Liability
To the fullest extent permitted by law, I shall not be liable for any indirect, incidental or consequential damages arising from the use of my services or website. My total liability shall not exceed the amount paid by the client for the services.
9. Website Use
All content on this website, including images, text and branding, is protected by copyright laws. Unauthorized use, reproduction or distribution is prohibited.
10. Privacy
Personal information collected through this website or during booking is handled in accordance with the Privacy Policy.
11. Governing Law
These Terms are governed by the laws of the State of Idaho, USA without regard to conflict of law principles.
12. Changes to Terms
I reserve the right to update or modify these Terms at any time. Continued use of the website or services after changes are posted constitutes acceptance of the revised Terms.
